  1. HOW DO WE PROCESS YOUR PERSONAL DATA?

The Company, in its capacity as Data Controller, processes the personal data of candidates applying for available positions, employees, individual clients, representatives of legal entity clients, contractual partners and collaborators, and other individuals who interact with the Company and/or are involved in contractual relationships with it.

Personal data are:

  • Processed legally, fairly, and transparently concerning the data subject;

  • Collected for specified, explicit, and legitimate purposes and not further processed in a manner incompatible with those purposes;

  • Adequate, relevant, and limited to what is necessary concerning the purposes for which they are processed;

  • Accurate and kept up to date;

  • Kept in a form that permits the identification of data subjects for no longer than is necessary for the purposes for which the data are processed;

  • Processed in a manner that ensures appropriate security of the personal data, including protection against unauthorized or unlawful processing and against accidental loss, destruction, or damage, by implementing appropriate technical or organizational measures.

  1. WHAT TYPES OF PERSONAL DATA ARE PROCESSED AND FOR WHAT PURPOSES?

To conclude and execute service and partnership/collaboration contracts, we primarily process the following types of personal data: name, surname, ID/passport series and number, gender, home/residence address, bank account number, email address, phone number.

To complete and submit the contact form ("We are happy to hear from you") on the Company's website – www.ro.trenkwalder.com (hereinafter "the website"), we process the following types of personal data: name, surname, email address, postal code, reason (looking for a job, looking for employees, employee, or others) and, if applicable, other data if provided by the data subject in the "Message" section.

To contact TRK PROFESSIONAL specialists, in addition to the contact form, the following methods are available: direct phone, chatbot, email, or callback service through which we process the following data: name, surname, phone number, preferred contact time, other data if provided by the data subject in the "Message" section or during the "Chat" online or in the "Email".

To apply for a position via the "We look forward to your application" form, we process the following data: social network profiles containing data entered/recorded by the data subject (LinkedIn, Google, Facebook), salutation, name, surname, preferred contact method, email address, phone number, postal code of the desired work location, date of birth, country, city, postal code, street name and number, desired position, expected start date, expected salary, current employer name, current/last job position, other data found in the CV added in the form, other data found in the cover letter, diplomas/references, photo and other data from a personalized document.

To schedule an online interview, we process the following data: phone number, preferred time slot, name, surname, and email address.

To create a CV on the website, we process the following data: choice of format and color, name, surname, profession, date of birth, email address, phone number, city, postal code, country of origin, photo, social network link, experience, professional summary, school/university name, country of graduation, diploma, field of study, start and end of studies, skills, language competencies.

To access the employee account, we process the following data: Google/Facebook account, account number, or email address and password.

To post testimonials on the website, we process the following data: name, surname, photo, or other data provided by the data subject in the testimonial.

To calculate the salary via the form present on the website, we process the following data: gross salary, religion, number of children, age and allowance of children, and insurances (e.g., health, sickness, unemployment).

For website visitors, we may collect data through cookies or similar technologies, such as: IP address, browser, location, web pages accessed on our website, time spent on the website, internet network, and device used.

We do not use your personal data to send marketing communications, such as newsletters unless you expressly consent to such communications by checking a consent box. In this regard, we only process your email and ensure you have a simple option to unsubscribe at any time, i.e., to withdraw your consent regarding receiving such communications.

  1. WHAT ARE THE LEGAL GROUNDS FOR PROCESSING PERSONAL DATA?

Your personal data are processed for:

  • The conclusion and execution of various contracts;

  • Fulfilling legal obligations incumbent on us;

  • Based on requested and/or previously offered consent (in the context of recruitment, for sending marketing communications, etc.);

  • The legitimate interests pursued by the Company (e.g., adopting protection and security measures for our employees, exercising legitimate rights and interests of the Company in contentious or non-contentious procedures, etc.).

  1. FOR HOW LONG DO WE PROCESS YOUR PERSONAL DATA?

Personal data are stored for processing for the duration necessary to achieve the processing purposes mentioned in this Policy or for the duration required by law (e.g., in terms of archiving, accounting, etc.).

  1. TO WHOM DO WE TRANSMIT PERSONAL DATA?

We will not communicate or transfer any of the personal data collected from or about you to any third party except:

  • Public authorities and institutions – when there is a legal obligation or in the interest of a legitimate interest (defending the Company's rights in contentious or non-contentious procedures, etc.).

  • The Company's contractual partners or collaborators who provide us with web hosting services, website development, website maintenance, online marketing, and marketing communications.

  • Any third party – if you have expressly and specifically consented to that situation and those data.

If the personal data processed by the Company are transferred directly or through its contractual partners/collaborators outside the European Economic Area, we ensure that these transfers comply with GDPR (especially Article 46 of GDPR), applicable legal provisions, based on adequate safeguards (standard data protection clauses adopted by the Commission) and provided that there are enforceable rights and effective legal remedies for the data subjects.

  1. WHAT PROTECTION MEASURES AND GUARANTEES DO WE TAKE?

The Company implements appropriate technical and organizational measures to ensure a high level of security and protection of personal data. We use security methods and technologies, together with internal work policies and procedures, including control and audit, to protect personal data collected according to relevant legal provisions in the field of personal data protection.

Any data subject can exercise the following rights as provided by the General Data Protection Regulation:

  • Right of access;

  • Right to rectification;

  • Right to erasure;

  • Right to restriction of processing;

  • Right to data portability;

  • Right to object to processing;

  • Right not to be subject to a decision based solely on automated processing, including profiling;

  • Right to address the National Supervisory Authority for Personal Data Processing (www.dataprotection.ro) and the courts.
